The Kiddush Levana App at kiddushlevana.app, operated by Turn Byte LLC, a Delaware limited liability company (“we”, “us”). Below, “the app” means this site and the installable app it offers.

Using the app means accepting what follows. It is short on purpose: the app is free, it has no accounts, it tracks nobody, and it asks nothing of you.

1. What the app is — and is not

The app shows the moon's position, estimated viewing windows, mapped building obstructions and weather forecasts. Terrain and trees are not included. It also includes the prayer text for use outdoors.

2. No warranty

The app is provided “as is” and “as available”, without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the app will be uninterrupted, error-free, or available at any given moment.

Astronomical positions use Astronomy Engine. The traditional molad uses the mean lunar month and Jerusalem mean solar time. Displayed times use the selected place's time zone. Building data may be missing or estimated; terrain and trees are not modeled. Weather, GPS and compass readings also have uncertainty.

3. Limitation of liability

To the fullest extent permitted by law, Turn Byte LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising out of your use of, or inability to use, the app — including any missed opportunity to say Kiddush Levana, any reliance on a time or direction shown, and anything that happens to you while walking outdoors looking at your phone. Our total liability for any claim relating to the app will not exceed twenty-five United States dollars (US$25).

Some jurisdictions do not allow certain limitations, in which case the limitations above apply to the fullest extent permitted.

4. Be sensible outside

The app can point you to a nearby spot with a clear line to the moon, and can hand the walk over to Google Maps. What it works from is a map of buildings. It cannot see traffic, kerbs, steps, roadworks, private property, or who else is about, and it does not know whether a street is one you should be on at night.

So: look up from the phone while you walk, cross where it is safe, keep to public streets, and use your own judgement. If a spot does not feel right, do not go there — the moon will still be up from somewhere else.

5. Privacy first

There is no third-party tracking of any kind. No analytics, no advertising, no tracking pixels, no fingerprinting, no social buttons, no accounts and no cookies. We run no server that receives your data, and we do not sell or share anything, because we do not have anything to sell or share. The app was built to work with nothing about you leaving your phone, and what little must leave it is listed here in full.

• On your device only. Your location, saved home, name, language, minhag, chosen basemap and whether you have marked this month as said are stored in your browser's local storage. They never leave the device, and Settings → “Clear saved data” removes them.
• Your location. Read from your browser only after you allow it, used to compute what is on screen, and not transmitted to us.
• A rough starting point. The app can show an approximate city from the hosting connection before an exact position is chosen. A city search is also approximate. GPS or a point chosen on the map can replace it. The app does not store the connection's IP address for this lookup.
• The contact form. What you type is sent to us as an email and kept only in that mailbox, so that we can reply. Nothing is stored in a database.

6. Open services the app looks things up from

The app tracks nobody, but it does look things up. Your browser fetches map tiles, building data, place names and the forecast directly from the open services below — the way it fetches any web page — so each receives your IP address and the coordinates or place name it is asked about, and nothing else. None of them is used to track you, we send them nothing about you ourselves, and their own privacy policies govern what they do with a request:

• OpenStreetMap — map tiles, and building footprints and heights via the Overpass API
• OpenTopoMap — terrain tiles
• GeoNames via Open-Meteo — city and postcode search, sent when you submit your search
• Open-Meteo — the sky forecast
• Leaflet — the map library is included with the app; no separate library-host request is made
• Google Maps — directions to a candidate spot, opened only when you tap a directions link. What happens in Maps is between you and Google.
• Cloudflare — hosting, the approximate starting location described above, and delivery of the contact form's message

7. Cookies

The app sets no cookies. Local storage, described above, stays on your device and is not sent to any server.

8. Using the app

The app is free to use for its intended purpose. Please do not attempt to disrupt it, to overload the third-party services it depends on, or to use the contact form to send unsolicited or abusive mail. The app's own code, design and text are © Turn Byte LLC; the liturgy is not ours and is not claimed.

9. Changes

We may update these terms. The date at the top says when they last changed, and continuing to use the app after a change means accepting the revised terms.

10. Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. The state and federal courts located in Delaware will have exclusive jurisdiction over any dispute arising from them.
